[Edaily Reporter kyoungeun kim ] On the 24th,LS SECURITIES(078020)announced a court-mediated settlement recommendation regarding a lawsuit filed by Korea Securities Finance Corporation seeking the return of unjust enrichment and other claims.
This lawsuit was filed by the plaintiff—an investor in asset-backed commercial paper (ABCP) related to China’s China National Energy Chemical Group (CERCG)—against LS SECURITIES and HANWHA INVESTMENT & SECURITIES, the entities involved in the issuance and underwriting, following the default on the ABCP.
The Seoul High Court ruled that the defendants must jointly pay the plaintiff 9.82767 billion won, plus late payment interest at an annual rate of 5% from November 9, 2018, to August 21, 2026, and at an annual rate of 12% from the day following that date until the date of full repayment; the plaintiff must waive the remaining claims; and each party must bear its own litigation costs.
However, this amount represents the full principal that the defendants are jointly liable to pay; the actual amount LS SECURITIES will pay is a portion of that total, based on the allocation ratio agreed upon among the defendants.
