Earlier today, the company issued a press release stating “This patent pertains to methods for the prevention or treatment of tumors through the combination of Tosfosertib with one or more of the following: major immune checkpoint inhibitor classes—such as anti-PD-1 antibodies, anti-PD-L1 antibodies, and anti-CTLA-4 antibodies—as well as lenvatinib.” It is assessed that the scope of exclusive rights is broad, as it encompasses the entire class of major immune checkpoint inhibitors—not limited to pembrolizumab, for which combination clinical trials are currently underway. According to the company, the five leading products in these major immune checkpoint inhibitor classes—excluding lenvatinib—have established themselves as core therapies in the anticancer drug market, with global sales alone reaching approximately $55 billion (about 75 trillion KRW) last year. The scope of the patent also covers various cancer types, including melanoma, breast cancer, pancreatic cancer, ovarian cancer, lung cancer, colorectal cancer, liver cancer, bile duct cancer, prostate cancer, kidney cancer, and head and neck cancer, thereby broadening the rights related to combination therapy with tosfosetib in multiple ways. In addition, the company has secured broad rights covering administration methods and dosage forms. These encompass various routes of administration, including oral administration, intravenous (IV) injection, subcutaneous (SC) injection, and intramuscular (IM) injection; the combination drugs can be administered as separate dosage forms or integrated into a single formulation. Administration methods such as concurrent, sequential, and separate administration are also fully reflected within the scope of the rights. This U.S. patent is valid through July 2042 and may be extended to July 2043 if the Patent Term Adjustment (PTA) system is applied. A representative of TiumBio Co., Ltd. stated, “This U.S. patent is an important milestone that solidifies the intellectual property rights for the combination therapy of tosfosetip and Keytruda, which is currently undergoing a Phase 2a clinical trial,” adding, “It is highly significant that we have secured an exclusive patent that broadly covers combination therapies of PD-(L)1 antibodies, CTLA-4 antibodies, lenvatinib, and tosfosetip across various cancer types and dosage forms.”
