After nearly four years of legal battles, the company has had the validity of its patent recognized, once again demonstrating its technological competitiveness. LX HAUSYS, LTD. announced on the 1st that the Second Division of the Supreme Court (Presiding Justice Oh Kyung-mi) recently dismissed the appeal and upheld the lower court’s ruling in a patent invalidation lawsuit filed against the company by Myeongil Foam Co., Ltd. This litigation began in March 2022 when LX HAUSYS, LTD. filed a patent infringement injunction lawsuit against Myeongil Foam regarding manufacturing technology for phenolic foam insulation that improves thermal insulation performance while enhancing environmental sustainability. Myeongil Foam filed a petition for invalidation of the patent in June of the same year. Previously, in its February appellate ruling, the Patent Court determined that LX HAUSYS, LTD.’s patent met the requirements for patentability and presented new technical challenges and solutions compared to existing insulation technologies. In particular, the court recognized the distinctiveness of the new technology—which improved thermal conductivity and enhanced environmental sustainability—and ruled that the patent was valid. Myeongil Foam appealed this decision, but the Supreme Court ultimately dismissed the appeal. Since becoming the first company in Korea to mass-produce PF insulation in 2013, LX HAUSYS, LTD. has continuously improved performance through ongoing research and development (R&D) investments. The company has not only secured the highest level of thermal insulation performance among domestic organic insulation materials for construction but has also achieved fire-resistant properties. An LX HAUSYS, LTD. official stated, “By securing a complete victory in the patent invalidation lawsuit, we have been able to solidify our technological leadership in the domestic insulation industry,” adding, “We will continue to focus on developing insulation products that meet the needs of the market and our customers, while actively protecting our related intellectual property rights.”
