According to Sisa Journal on the 3rd, the U.S. District Court for the Northern District of California granted Choi Si-won’s motion for discovery filed on the 2nd against 10 users of X (formerly Twitter) and YouTube.
Discovery is a U.S. legal procedure that allows a party to request the submission of relevant materials from the opposing party or a third party in order to secure evidence necessary for a lawsuit.
Choi Si-won’s legal team reportedly requested that the platform operators provide user information—including names, dates of birth, and addresses—arguing that they needed to identify the authors of malicious posts in order to proceed with a civil damages lawsuit in South Korea.
With the court’s approval, Choi Si-won’s legal team can now verify the authors’ identities and proceed with civil and criminal legal actions in South Korea.
Previously, in February, Choi Si-won drew attention by posting the phrases “不義必亡 (Injustice will surely lead to ruin)” and “土崩瓦解 (A complete and uncontrollable collapse)” on his social media accounts. “不義必亡” means that injustice will inevitably lead to ruin, while “土崩瓦解” refers to a situation where an organization or structure collapses uncontrollably.
SM Entertainment also stated last February, “We are continuously identifying malicious posts targeting our artists, including personal attacks, insults, and the dissemination of false information,” adding, “We plan to collect evidence regarding illegal online activities and gradually expand our legal actions.”
