On the 14th, Kim Soo-hyun’s agency, Gold Medalist, stated, “Regarding the false allegations that Mr. Kim Soo-hyun dated the deceased when she was a minor, and the subsequent claims of violations of the Child Welfare Act based on those allegations, investigative authorities reviewed the relevant materials and facts and determined that the allegations could not be substantiated, resulting in a decision not to refer the case to the prosecution with a finding of ‘no grounds for suspicion.’” "It has been confirmed that the series of allegations made against Mr. Kim Soo-hyun lack factual and objective grounds. This matter is no longer a matter of debate regarding the truth of the facts, but rather a falsehood proven through official investigation results," the agency announced.
The agency went on to mention that Kim Se-ui of the Garo-Sero Research Institute—who first raised and disseminated the false claims—has been arrested and indicted on charges including defamation by disseminating false information under the Information and Communications Network Act, “We ask that you clearly recognize that, under these circumstances, continuing to cite the content claimed by Kim Se-ui or reposting, sharing, or redistributing it as if it were true constitutes an additional illegal act that condones the criminal behavior of Kim Se-ui—who has been arrested and indicted—and perpetuates and exacerbates the criminal harm caused by his actions,” the agency emphasized.
The organization also warned that the re-dissemination of false information after the facts have been established may result in aggravated penalties. It stated that even after the investigation results and the fact that the original disseminator has been arrested and indicted have been officially confirmed, creating false content or sharing, reposting, or redistributing related posts, videos, or comments constitutes an illegal act of intentionally amplifying and reproducing false information. It further noted that posting, sharing, reposting, or redistributing broadcast screenshots, thumbnails, photos, screenshots, and other audiovisual materials used or disclosed in Garosero Research Institute broadcasts—or excerpting, altering, or editing them to amplify and reproduce the content—may be deemed malicious additional harm against the crime victim and an act intended to intentionally exacerbate the damage. The agency warned that it would take all legal measures to ensure that severe penalties and accountability are imposed for such acts of dissemination.
Furthermore, the agency stated that insults, malicious slander, and acts of obstruction of business are also subject to legal action without exception.
The agency emphasized that anyone who has created, shared, reposted, or redistributed posts, videos, images, or comments containing false information, insults, or defamatory content regarding Kim Soo-hyun must immediately delete such content, and explaining, “Whether or not the content is voluntarily deleted may be taken into consideration when determining sentencing and calculating damages in future legal proceedings; however, even if deleted, criminal and civil liability for the illegal acts already committed will not be waived.”
Furthermore, the agency emphasized, “We are proceeding with sequential criminal prosecution against all confirmed offenders for any acts that infringe upon the rights and interests of our artists and interfere with our normal business and operational activities.”
